INFORMATION NOTICE ON THE PROCESSING OF PERSONAL DATA

COOKIE POLICY

This document describes the management methods of the websites www.matchplat.com and www.matchplat.it (hereinafter the “Site”) with reference to the processing of personal data of users who consult it.

Data Controller

Following consultation of this Site, data relating to identified or identifiable persons may be processed (data subject under the Regulation, hereinafter “user”). The controller of the processing of personal data is Matchplat S.r.l. – Company subject to management and coordination by Mobo Holding S.r.l. (hereinafter “controller”). General information on cookies

Cookies are small strings of text (letters and/or numbers) that the websites visited by the user send to the browser, where they are stored to be retransmitted to the same websites at the next visit of the same user. Cookies are stored by the individual browser on the specific device used (computer, tablet, smartphone, etc.). While browsing a website, elements from other sites (such as images, maps, sounds, specific links to other domains) may also be present. In these cases, the user may also receive cookies sent by these third parties (called third-party cookies). If cookies are sent directly by the site being visited, they are called first-party cookies.

Similar technologies, such as web beacons and clear GIFs, may also be used to collect information on user behavior and service usage. In this document, we will refer to cookies and all similar technologies simply using the term “cookies”. Cookies are classified according to their purpose, duration, and the site that sets them.

Session cookies are stored temporarily in the device’s memory during website browsing, for example, to keep track of the chosen language or authentication for access to reserved areas. Session cookies remain stored on the device for a short period of time and are deleted once the user closes the browser. Persistent cookies save a file on the device for a longer period. This type of cookie has an expiration date. Persistent cookies allow websites to remember information and settings during subsequent visits, making browsing easier and faster, for example because it is no longer necessary to log in again to a reserved section. Upon expiration, the cookie is automatically deleted when accessing the site that created it.

The regulation requires the controller to provide the user with information on the cookies used by the site and the purposes for which they are used. The aim is threefold: to guarantee privacy, ensure ease of use, and optimize the development of the site. The main types of cookies and the related purposes used by the site are illustrated below.

Technical cookies – Purpose and lawfulness of processing

Technical cookies are used solely for the purpose of carrying out “the transmission of a communication over an electronic communications network, or to the extent strictly necessary to the provider of an information society service explicitly requested by the subscriber or user to provide that service”. They are not used for further purposes and are normally installed directly by the site owner or operator. Functionality cookies are technical cookies and allow the user to browse according to a series of selected criteria (e.g., the language, products selected for purchase) in order to improve the service provided. Analytics cookies, when used directly by the site operator to collect aggregated and anonymous information on the number of users and how they visit the site, are considered technical cookies.

The personal data of the user are processed by the controller so that the site functions properly and provides useful information to the user who visits it. The lawfulness of the processing of personal data is based on the need to pursue the legitimate interest of the controller (Article 6.1 letter f) of the Regulation). For the installation of all types of technical cookies, the user’s prior consent is therefore not required.

Profiling cookies – Purpose and lawfulness of processing

Profiling cookies are intended to create user profiles and are used to send advertising messages in line with the preferences expressed by the user when browsing the web. Due to the particular invasiveness that such tools may have within the private sphere of the user, European and Italian legislation provides that the user must be adequately informed about their use and express valid consent. In particular, profiling cookies are used to publish personalized advertising messages based on the user’s interests: targeting or promotional cookies. These make it possible to obtain detailed information on the user’s navigation on the site (for example, the products or services most viewed by a given person). They also make it possible to recognize a user returning to visit the site. Analytics cookies, when used directly by the site operator to collect information not in aggregated and anonymous form on the number of users and how they visit the site, are considered profiling cookies.

The site uses profiling cookies sent directly by Matchplat S.r.l. – Company subject to management and coordination by Mobo Holding S.r.l. – as well as by third parties.

The user’s personal data are used in order to send advertising messages in line with the preferences expressed by the user during web browsing.

The lawfulness of the processing of personal data collected with profiling cookies is based on the user’s free, explicit and informed consent (Article 6.1 letter a) of the Regulation).

WordPress Stats

This site uses the WordPress Stats monitoring system, an analytics service provided by Automattic Inc., based in San Francisco – CA (USA).

The WordPress Stats system uses cookies to analyze how users navigate the site.

Matchplat S.r.l. – Company subject to management and coordination by Mobo Holding S.r.l. – will use this information to examine the use of the site, compile reports on site activity for site operators and provide other services relating to site activity and internet usage in aggregated and anonymous form.

Google Analytics

This site uses the Google Analytics monitoring system, an analytics service provided by Google LLC, based in Mountain View – CA (USA).

The Google Analytics system uses cookies to analyze how users navigate the site.

Methods of user notification and consent management for the use of profiling cookies

When the site is first visited, a banner (advertising notice) is displayed to inform the user that the site may use profiling cookies as well as monitoring systems as described in this document, only if explicitly approved by the user. If the banner is closed by the user without changing the cookie and monitoring system settings, the site will only use technical (or necessary) cookies. The banner contains a link to this page where the user can find further information on the management of cookies used by the site. The banner will not be displayed again on subsequent visits to the site.

Deactivation, activation, deletion of cookies and their consequences

At any time, the user can limit or block cookies through the browser settings (Microsoft Edge, Google Chrome, Mozilla Firefox, Opera, Safari, etc.). The setting can be defined specifically for different sites and web applications. If the storage of technical cookies is blocked, the controller can no longer guarantee the correct functioning of the site and therefore some functions may not be available. Cookie settings must be managed separately in each browser and device used (PC, notebook, smartphone, tablet, etc.).

Methods of processing personal data

Personal data are processed with automated tools for the time strictly necessary to achieve the purposes for which they were collected as set out in the relevant cookie table above.

Specific security measures are observed to prevent loss, unlawful and/or incorrect use, and unauthorized access to data.

Communication and dissemination of personal data

Personal data, where necessary, may be communicated (meaning disclosed to one or more specific parties):

– to parties whose right of access to the data is recognized by national and European Union law;

– to natural and/or legal persons, public and/or private, when communication is necessary or functional to the activity of the controller in the ways and for the purposes described above;

– to employees/collaborators of the controller, within the scope of their duties and/or any contractual obligations;

– to parties acting as processors and/or sub-processors of personal data pursuant to Article 28 of the Regulation, entrusted with institutional and/or technical management tasks of the site (e.g., hosting, management of databases used by the site).

Personal data are not disseminated, meaning disclosed in any way to an indefinite number of parties. Personal data, without prejudice to their free circulation within the European Economic Area (EEA), are also transferred outside the EEA, specifically to the United States of America (USA). The legal basis for transfer to the USA is the adequacy decision adopted by the European Commission (Data Privacy Framework).

Criteria used to determine the retention period of personal data

Personal data processed through technical cookies are stored for the time established by the site (first or third party) that installs them.

Personal data processed through profiling cookies are stored for the time established by the site (first or third party) that installs them, or until the withdrawal of consent given by the user for such purposes.

Personal data processed through monitoring systems and used for statistical and/or marketing purposes are stored until the withdrawal of consent given by the user for such purposes.

Amendments to this information notice

The controller reserves the right to make changes to this information notice at any time, informing the user on this page. Users are therefore invited to consult this page frequently to be constantly updated.

Rights of the data subject (user)

Users are informed that, at any time, they may exercise the following rights:

  • right to receive in a structured, commonly used and machine-readable format the personal data concerning them provided to a controller, and the right to transmit those data to another controller without hindrance from the controller to which the data have been provided;
  • right to obtain access to their personal data;
  • right to obtain rectification of their personal data, where not contrary to applicable data retention laws;
  • right to obtain erasure of their personal data, where not contrary to applicable data retention laws;
  • right to obtain restriction of processing of their personal data;
  • right to object at any time, on grounds relating to their particular situation, to the processing of their personal data;
  • right to withdraw consent to the processing of their personal data at any time, without affecting the lawfulness of processing based on consent before its withdrawal;
  • right to object at any time to the processing of their personal data for direct marketing purposes, including profiling to the extent that it is related to such direct marketing;
  • right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning them or similarly significantly affects them.

Right to lodge a complaint

The user has the right to lodge a complaint with a supervisory authority (in particular, with the Italian Data Protection Authority www.garanteprivacy.it).
